United States Attorney Brendan V. Johnson announced that a Kyle, South Dakota, man was acquitted on August 4, 2011, of First Degree Burglary and Assault with a Dangerous Weapon as a result of a federal jury trial in Rapid City, South Dakota. Charles Blue Bird, a/k/a "Hokie", was indicted by a federal grand jury in Rapid City on April 19, 2011.
The charges related to the alleged entering of an occupied structure, during the nighttime, on May 8, 2010, in Kyle, with the intent to assault a female with a tree branch.
The investigation was conducted by the Bureau of Indian Affairs and the Oglala Sioux Tribe Department of Public Safety. The United States Attorney's Office prosecuted the case.
